W. Pearce Nesbitt appeared on behalf of the USA. The Court finds that an interpreter is required for today's hearing and all future proceedings. Dft, after being sworn, competently, knowingly, voluntarily and intelligently waived his right to a preliminary hearing. The US advised that an administrative ICE detainer is pending. Defense counsel agreed the issue of detention is not yet ripe. If and when the issue becomes ripe, Dft may file a motion for detention hearing and the Court will promptly set a hearing. The Court advised Dft of his/her consular notification rights per the Vienna Convention on Consular Relations. The Court orders a Spanish interpreter for today and all future proceedings. Pursuant to the Due Process Protections Act, the court reminds the government of its obligations under Brady v. Maryland, 373 U.S. 83 (1963), to disclose evidence favorable to the dft and material to the dft's guilt or punishment. The govt is ordered to comply with Brady and its progeny. The Court appoints Thomas Miceli as counsel for Dft under the terms of the CJA. Dft advised of Constitutional Rights pursuant to Rule 5(d).
